Proposed waste reforms – waste levy and financial assurances
As part of the Waste Reform Program, the EPA is seeking your views on two proposed reforms: amendment to how the waste levy is collected from landfills and the approach to the application of financial assurances to stockpiles.
Waste levy collection
These proposed amendments aim to ensure that the solid waste levy is collected from landfills in a fair and consistent manner, which drives positive resource recovery and environmental outcomes.
To achieve this, draft legislation has been developed for stakeholder consultation which seeks to amend provisions of the Environment Protection Regulations 2009 and the Environment Protection (Waste to Resources) Policy 2010.
In 2017, the Environment Protection Act 1993 was amended to include more comprehensive provisions on financial assurances, allowing for assurances to be used to address the risks associated with unauthorised stockpiling or abandonment of waste or other matter as well as environmental harm risks.
The EPA is seeking industry feedback on the information sheet, Financial assurances and stockpiling - who, when, what and how much. It outlines the EPA’s proposed approach to requiring financial assurances to deal with stockpiling.
Consultation is open until Monday, 21 October 2019. Submissions on either or both waste levy collection and the financial assurance approach may be forwarded by mail or email (preferred) to:

This is an opportunity for you to have your say and influence the proposed reforms. Detailed feedback in relation to how the proposed changes may impact on your business is encouraged. Feedback from the consultation period will be taken into account in finalising any proposed changes.
